Services Overview

20North has entered into agreements with various product suppliers and online retailers (the “Merchants”) in the USA and other countries under the terms of which 20North displays products from Merchants’ or Merchants’ suppliers’ electronic catalogs (the “Products”) on the Website and takes orders from customers for purchase and delivery to India of  those Products that are freely importable into India as per the Indian Foreign Trade Policy and collects advance payment for such orders including estimated shipping and handling charges and estimated import duties, taxes and cesses (collectively the "Import Fees").

All products/services and information displayed on 20North.com constitute an "invitation to offer". Your order for purchase constitutes your "offer" which shall be subject to the terms and conditions as listed below. 20North reserves the right to accept or reject your offer. If you have supplied us with your valid email address, we will notify you by email as soon as possible to confirm receipt of your order. No act or omission of 20North prior to the actual dispatch by the Merchants of the product(s) ordered will constitute acceptance of your offer.  

Eligibility

Use of the Website is available only to persons who can form legally binding contracts under applicable law. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Site. If you are a minor i.e. under the age of 18 years but at least 13 years of age you may use this Website only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If your age is below that of 18 years your parents or legal guardians can transact on behalf of you if they are registered users. You are prohibited from purchasing any material which is for adult consumption the sale or purchase of which to/by minors are strictly prohibited.

20North reserves the right to terminate your usage of the Website and refuse to provide you with access to the Website if 20North discovers that you are under the age of 18 years. If you are registering as a business entity, you represent that you have the authority to bind the entity to this User Agreement.

Except where additional terms and conditions are provided which are product specific, these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. By using the Services you agree to be bound by the Terms and Conditions.

Account and Registration Obligations

"Your Information" is defined as any information you provide to us in the registration, buying or listing process, in the feedback area or through any email feature. We will protect Your Information in accordance with our Privacy Policy. If you use the Site, you are responsible for maintaining the confidentiality of Your Account and Password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under Your Account or Password. 20North shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account. If you know or suspect that someone else knows your password you should notify us by contacting us immediately through the address provided below. If 20North has reason to believe that there is likely to be a breach of security or misuse of the Site, we may require you to change your password or we may suspend your account without any liability to 20North.

HOW IS YOUR INFORMATION USED?

• To get in touch with you when necessary and to provide the services requested by you
• Contact you to solicit feedback regarding our services and occasionally to send you promotional offers.

You also agree to:

1. Provide true, accurate, current and complete information about yourself as prompted by 20North's registration form (such information being the "Registration Data")
2. Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, incomplete, or not current or if 20North has reasonable grounds to suspect that such information is untrue, inaccurate, not current or not in accordance with the User Agreement, 20North has the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Site.

Pricing Information

While 20North strives to provide accurate product and pricing information, pricing or typographical errors may occur. 20North cannot confirm the price of a product until after you order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, 20North shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. In the event that an item is price is mis-quoted, 20North may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted and 20North will have the right to modify the price of the product and contact you for further instructions using the e-mail address provided by you during the time of registration, or cancel the order and notify you of such cancellation. In the event that 20North accepts your order the same shall be debited to your credit card account and duly notified to you by email that the payment has been processed. The payment may be processed prior to 20North dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit card account.

Import Fees Deposit

Each item in your order for delivery to India may be subject to Import Fees. The "Import Fees Deposit" represents an estimate (and is not an exact calculation) made by 20North of the Import Fees that are applicable on the items in your order. The applicable Import Fees are clearly indicated alongside each item available for ordering on the Site.

By placing an order on 20North, you agree to allow 20North to collect at the time of order placement, the Import Fees Deposit for the applicable items in your order.

With respect to each item in your order for which Import Fees have been estimated and collected in advance, you authorize 20North, or an agent appointed by 20North, or a carrier designated by 20North ("Designated Carrier"), to act as your agent and on your behalf with the relevant customs and tax authorities in India, to clear your merchandise, process and remit the import fees for such item in your name and on your behalf.

Customs regulations and duty and tax rates applicable to certain items may change between the date the Import Fees Deposit was estimated and the applicable taxes and duties are paid on the date of entry. Also, classification of goods as made by 20North may differ from the classification made by the assessing authority in India resulting in a difference between the Import Fees Deposit and actual import fees paid. You agree not to dispute and accept as final the decision made by 20North with regard to the import fee estimation.

In the event that the Import Fees Deposit is materially greater than the actual import fees, you will automatically be refunded the difference to the payment method you used for the order. You will receive a notification e-mail to confirm the amount of the refund. In the case of gifts or other purchases made on behalf of another recipient, you agree to secure and make the foregoing authorizations to 20North on behalf of the recipient designated in your order.

Cancellation by 20North

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, problems identified by our credit and fraud avoidance department and banned products that cannot be imported or cleared by the Customs Department of The Govt of India We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your Card Account.

Cancellations by the Customer

In case we receive a cancellation notice and the order is yet to be processed / approved by us, we shall cancel the order and refund the entire amount subject to deduction of cancellation fees. We will not be able to cancel orders that have already been processed and shipped out by us. 20North has the full right to decide whether an order has been processed or not. The customer agrees not to dispute the decision made by 20North and accept 20North's decision regarding the cancellation.

Return and Refunds

The 20North return policy is based on a "no-questions asked" philosophy (for eligible products) but with some restrictions that stem from the reality that our products are sourced from merchants located primarily in the US. Our policy is formulated keeping in mind the cost and time involved in the reverse logistics (i.e. the process of shipping returned products back to the US merchants). The policy itself is simple and straight-forward and can be read in full at Return and Refund Policy.

Credit Card Details

You agree, understand and confirm that the credit card details provided by you for availing of services on 20North will be correct and accurate and you shall not use the credit card which is not lawfully owned by you, i.e. in a credit card transaction, you must use your own credit card. You further agree and undertake to provide the correct and valid credit card details to 20North. Further the said information will not be utilised and shared by 20North with any of the third parties unless required for fraud verifications or by law, regulation or court order. 20North will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively on you.

Fraudulent /Declined Transactions

20North reserves the right to recover the cost of goods, collection charges and lawyers fees from persons using the Website fraudulently. 20North reserves the right to initiate legal proceedings against such persons for fraudulent use of the Website and any other unlawful acts or acts or omissions in breach of these terms and conditions.

E-Gift Cards and Discount/Promotional Coupons

Duty Free Gifting

All goods imported into India from abroad is liable to duties of Customs under Section 12 of the Customs Act and also is liable to all the restrictions under the Foreign Trade (Development & Regulations) Act 1992. However, the Government has exempted gifts received from abroad by persons residing in India from the whole of duties of Customs and from restriction under FT (D&R) Act. At present, import of goods upto the value of Rs. 10,000/- is allowed as gift, duty free. This exemption is allowed only for bonafide gifts imported by air or post. For the purpose of calculation of this value of Rs. 10,000/- the air freight or postal charges paid are not added.

Important note : Customs authorities in India may deem an incoming gift as dutiable even though it is meets the specified guidelines for a duty free gift. This is completely at the customs authorities' discretion and typically no clear reason is provided. In such cases the courier delivering the product will collect applicable duty from the gift recipient before delivering the goods. The recipient will need to pay the applicable duty.

Reward Points Redemption Program

• Multiple point earnings programs may be made available on 20North.com but a 20North customer eligible for earning points as part of more than one point-earning program offered on 20North.com shall be required, at the time of each transaction, to make a mutually exclusive choice between the various points earning programs for which he/she may be eligible. 
• Point earning programs cannot be combined with any promotional or discount offer available on 20North.com and customers shall not earn any points (for which they otherwise may be eligible) as part of a transaction that avails of any promotional or discount offer on 20North.com.
• Multiple point redemption programs may be made available on 20North.com but a 20North customer eligible for redeeming points as part of more than one point-redemption program offered on 20North.com shall be required, at the time of each transaction, to make a mutually exclusive choice between the various point-redemption programs for which he/she may be eligible.

Electronic Communications

When you visit the Website or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

You Agree and Confirm

1)       That in the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by 20North for redelivery shall be claimed from you.

3)       You will provide authentic and true information in all instances where such information is requested of you. 20North reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), 20North has the right in its sole discretion to reject the registration and debar you from using the Services of 20North and / or other affiliated websites without prior intimation whatsoever.

4)       That you are accessing the services available on this Website and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction through this Website

5)       That the address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.

6)       That before placing an order you will check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale included in the item's description, geographical limitation of warranty and notifications of voltage incompatibility in case of electronic/electrical products.

Governing Law and Jurisdiction

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Bangalore shall have exclusive jurisdiction in any proceedings arising out of this agreement.

Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by 20North Online Pvt Ltd. and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Bangalore. The High Court of judicature at Bangalore alone shall have the jurisdiction and the Laws of India shall apply.

You may terminate this User Agreement at any time, provided that you discontinue any further use of this Site. 20North may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, Such termination will be without any liability to 20North. Upon any termination of the User Agreement by either you or 20North, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the User Agreement or otherwise. 20North's right to any Comments shall survive any termination of this User Agreement.
